An executive agency can run a competitive purchase under section 3301 but leave one supplier out to create or keep another source if the agency head decides it will help. Reasons include increasing or keeping competition and lowering costs; protecting national defense by keeping a facility, supplier, or research ability ready for emergencies; keeping a steady, reliable supply; meeting needs based on past high demand; or filling urgent medical, safety, or emergency supply needs. The agency cannot make this choice for a whole class of purchases or contracts. An agency can also limit competition to only small businesses under sections 9 and 15 of the Small Business Act (15 U.S.C. 638, 644). Contracts awarded this way do not need the written justification and approval that section 3304(e)(1) normally requires.
