You do not have to give certified cost or pricing data under section 3502 when one of three things applies: (1) the price was set by real competition or by law or regulation; (2) the purchase is a commercial product or commercial service; or (3) the head of the buying agency personally approves a waiver and writes down the reasons. If a contract for a commercial product or service is changed, you still don’t need to provide the data if the original contract met (1) or (2) and the change does not turn it into a noncommercial purchase.
