When someone files a protest under the rules in subchapter V of chapter 35 of title 31 about a contract solicitation, award, or proposed award, the agency that ran the procurement must create a protest file if an actual or potential bidder asks. The agency must give reasonable access to that file to actual or prospective offerors. Information that is exempt from disclosure under section 552 of title 5 can be redacted in the file unless a protective order says otherwise. If the agency head finds the solicitation, proposed award, or award broke a law or rule during the protest, the agency head may take any action listed in subparagraphs (A)–(F) of section 3554(b)(1) of title 31. The agency head may also pay the protest costs described in section 3554(c)(1) of title 31, within the limits in section 3554(c)(2).
