Employers covered by this rule must not refuse to hire someone just because they can’t show a birth certificate if the person gives an honorable discharge (or a replacement certificate) from the Army, Air Force, Navy, Marine Corps, Space Force, or Coast Guard. The only exception is when the discharge itself clearly shows the person may have been a noncitizen when it was issued. The rule covers employers who make, store, or maintain weapons, military supplies, machinery, tools, clothing, food, fuel, or parts, or who build, fix, or install plants or facilities — when that work is done under a federal contract or under a contract the President or the Secretary of the Army, Air Force, Navy, or the Secretary of the department that runs the Coast Guard says is needed for national defense.
