The Secretary must do site-characterization work at Yucca Mountain to get the data needed to decide if a repository can be built there. Before digging shafts, the Secretary must send a plan to the Commission and to the Governor or legislature of Nevada for review. That plan must describe the site, the planned work (how much excavation, any tests with radioactive or nonradioactive material, and any work that could affect the site’s ability to hold waste), how safety and cleanup would be handled, criteria for judging site suitability, the possible form or packaging of the waste and how it relates to the geology, and a basic repository design. The Secretary must make the plan public, hold local hearings, and report at least once every 6 months to the Commission and to the Governor and legislature of Nevada about the work and what is learned. Only activities needed to get the required data and meet the National Environmental Policy Act may be done. Radioactive materials may not be used unless the Commission agrees it is necessary; if used, the amount must be the minimum and no more than the curie equivalent of 10 metric tons of spent nuclear fuel, and it must be fully retrievable. If the site is found unsuitable, the Secretary must stop work, tell Congress and Nevada officials why, remove any radioactive material promptly, reclaim and mitigate the site, suspend future benefit payments under part F for that site, and report to Congress within 6 months with further recommendations. Activities done under these rules are treated as preliminary decisionmaking and do not require an environmental impact statement or certain other NEPA reviews.
