Repositories built on an approved site must be made so spent nuclear fuel can be taken back out while the facility is operating, if needed for public health, the environment, or to recover valuable materials. The Secretary must set how long fuel must be retrievable when the repository is designed, and the Commission must approve or disapprove that plan during the construction authorization process under subsections (b) through (d) of section 10134 of this title.
