Title 42 › Chapter 108— NUCLEAR WASTE POLICY › Subchapter V— NUCLEAR WASTE TECHNICAL REVIEW BOARD › § 10262
Creates an independent Nuclear Waste Technical Review Board inside the executive branch. The Board must have 11 members picked by the President no later than 90 days after December 22, 1987. The President must pick one member to be chair. The National Academy of Sciences must nominate at least 22 people for those spots within 90 days after December 22, 1987, and must name at least 2 candidates for any future vacancy. Nominees must be highly respected experts in science or engineering (including environmental science), chosen only for proven records of distinguished service, and the Board must cover a wide range of related scientific and engineering fields. No nominee may be an employee of the Department of Energy, a DOE national laboratory contractor, or an entity doing high-level radioactive waste or spent fuel work under DOE contract. Vacancies are filled by the same nomination and appointment process. Members serve 4-year terms that begin 120 days after December 22, 1987. For the first 11 members, the President will name 5 to serve 2 years and 6 to serve 4 years.
