Defines key words used to protect people with mental illness in care settings. Abuse means a facility worker, acting on purpose or through reckless behavior, did or failed to do something that caused or might have caused injury or death to a person with mental illness; it includes things like rape or sexual assault, hitting, using too much force to put on restraints, and using physical or chemical restraints in ways that break Federal or State rules. Eligible system means the State program set up to protect and advocate for people with developmental disabilities under the Developmental Disabilities Assistance and Bill of Rights Act of 2000. Facilities can include hospitals, nursing homes, community mental health places, board-and-care homes, homeless shelters, jails, and prisons. Individual with mental illness means someone a qualified mental health professional says has a serious mental illness or emotional problem and who is either in or being admitted to a care facility (including being transported or involuntarily held in municipal detention not for serving a sentence) or who meets that clinical test and lives in the community, such as in their own home. Neglect means a careless act or failure to act by someone responsible for services in a facility that caused or could have caused injury or death, or put the person at risk; this covers failing to follow or make a proper treatment plan, not providing enough food, clothing, or health care, or not keeping a safe place and enough trained staff. Secretary means the Secretary of Health and Human Services. State means the 50 States, the District of Columbia, Puerto Rico, Guam, the Northern Mariana Islands, American Samoa, the Virgin Islands, and the Trust Territory of the Pacific Islands. American Indian consortium means a group created under part C of the Developmental Disabilities Assistance and Bill of Rights Act.
