Before filing a lawsuit in Federal or State court for a person with mental illness, an eligible system, or a State agency or nonprofit with a contract under section 10804(a) must first use all appropriate administrative steps in a timely way. If those steps won’t resolve the issue within a reasonable time, they may try other options, including suing. The rule does not apply when a legal action is needed to prevent or stop imminent serious harm to the person.
