Title 42 › CHAPTER 120 — ENTERPRISE ZONE DEVELOPMENT › § 11504
The Secretary of Housing and Urban Development, or the Secretary of Agriculture for rules under Title V of the Housing Act of 1949, can waive or change federal rules for an area that local governments have named an enterprise zone when those governments send a written request. The goal must be to help create jobs, improve the community, or boost the local economy. The request must say which rule would change, what change is wanted, and briefly why it will help. If the request goes to Agriculture, a copy must also go to HUD. The Secretary will weigh how much the change would help the zone against how it would affect the laws that apply there. The Secretary must approve the request if the public interest in the change is greater than keeping the rule unchanged. The Secretary cannot approve a change that would break a statutory requirement or likely create a big risk to public health, environmental health, or safety. No rule that protects people from discrimination on the basis of race, color, religion, sex, marital status, national origin, age, or handicap can be waived. If denied, the Secretary must write the reasons and try to work out an alternative. A decision must be made within 90 days. Waivers end when the enterprise zone designation ends. "Rule" and "Secretary" are defined in the law.
