Members of the National Civilian Community Corps are generally not federal employees and are not covered by federal employee rules. They are treated as U.S. employees only for two things: workers’ compensation under subchapter I of chapter 81 of title 5 (with "employee" as defined in section 8101 of title 5), and for tort claims under chapter 171 of title 28. For workers’ compensation, a member is not on duty while away from their assigned post unless the Director has approved the absence under the Director’s procedures.
