Programs or activities that get money under this subchapter must not exclude people, deny them benefits, or treat them unfairly because of race, color, national origin, religion, or sex. Protections against age discrimination under the Age Discrimination Act of 1975 (42 U.S.C. 6101 et seq.) and protections for otherwise qualified people with disabilities under section 794 of title 29 also apply, but the Secretary may waive these rules for funds used on lands set aside under the Hawaiian Homes Commission Act, 1920 (42 Stat. 108).
