A homeownership program must let eligible families buy an ownership interest or shares in units of a qualifying property so they can live there. The program can use different ownership types the Secretary allows, like co-ops, limited-equity co-ops, condos, or full ownership. Sales prices must include costs such as principal, insurance, taxes, interest, and closing costs, and be set so a family never has to pay more than 30 percent of its adjusted monthly income to complete a sale. The program must include a plan for choosing eligible families, offering relocation help to people who move, keeping units affordable over time, and giving ongoing training and counseling to buyers and owners. Acquisition or rehab usually must cover all units unless the Secretary finds selling fewer buildings is feasible and won’t harm remaining tenants. The application must explain how rehab and purchases will be financed (for example, grants, cash sales, conventional loans, or FHA-insured loans). Transferred property can’t be used as collateral or otherwise encumbered unless the Secretary finds it won’t threaten long-term low-income occupancy, won’t create undue federal or agency risk, the debt can be paid from project income, and the funds are used only for housing standards or approved capital improvements. Lenders must give the housing agency, resident group, or owner a reasonable chance to fix a default before foreclosing. Units must be free of health or safety hazards before transfer and meet the Secretary’s minimum housing standards within 2 years after transfer. No tenant living in a unit when the Secretary approves the grant may be evicted because of the program. If a tenant does not or cannot buy, the Secretary must, subject to available funds, make rental assistance under section 1437f available to qualified tenants, and the program must tell tenants about any relocation assistance the program will pay.
