Title 42 › CHAPTER 7 — SOCIAL SECURITY › SUBCHAPTER XI — GENERAL PROVISIONS, PEER REVIEW, AND ADMINISTRATIVE SIMPLIFICATION › Part A — General Provisions › § 1314b
The Secretary of Health and Human Services must create a National Advisory Committee on the Sex Trafficking of Children and Youth no later than 2 years after September 29, 2014. The group can have up to 21 members. The Secretary will pick members after talking with the Attorney General and the National Governors Association. At least one member must be a former sex trafficking victim. Two members must be State Governors, one Democrat and one Republican. Members serve for the life of the Committee and are unpaid. Vacancies are filled the same way the original members were chosen. The Committee must advise the Secretary and the Attorney General on how the nation can better respond to child and youth sex trafficking and how different governments and agencies can work together. Within 2 years after it starts, the Committee must create two levels of best practices for States: Tier I for States just beginning work and Tier II for States already taking action. These best practices must be based on research and real programs and include user-friendly tools like training materials, screening tools, teamwork plans across systems, rules for safe housing for trafficking victims, and caregiver training. The Committee must keep Governors and child welfare agencies informed every quarter and give States six months’ notice before checking how well they adopt the recommendations. The Committee must give an interim report by 3 years and a final report by 4 years to the Secretary, the Attorney General, the Senate Committee on Finance, and the House Committee on Ways and Means. The Administration for Children and Families will support the Committee, which must meet at least twice a year and allow remote participation. The Committee ends 5 years after it starts, but the Secretary must keep a public website with the best practices and State-by-State updates. The term “sex trafficking” uses the definitions in title 22.
