Title 42 › Chapter 7— SOCIAL SECURITY › Subchapter XI— GENERAL PROVISIONS, PEER REVIEW, AND ADMINISTRATIVE SIMPLIFICATION › Part A— General Provisions › § 1320a–3a
Requires any provider paid under Medicare Part B to give the Secretary full information before payment. The provider must list everyone who owns or controls the provider or any subcontractor in which the provider has a 5 percent or larger interest. For each person listed and for any managing employee, the provider must say what other Medicare Part B–billing entities that person owned or controlled now or at any time in the past 3 years, and must say if that person faced penalties, assessments, or exclusions under sections 1320a–7, 1320a–7a, or 1320a–7b. The provider must also give the employer identification number (EIN) and the social security number (SSN) for the provider and for each person named. The provider must tell the Secretary about any updates within 180 days. The Secretary will send SSNs to the Social Security Administration and EINs to the Treasury so those agencies can check and fix the information and report back. The Secretary will pay those agencies for the checking work at a negotiated rate. Definitions: disclosing part B provider — an entity paid on an assignment basis for Part B services (except an entity in 1320a–3(a)(2)); managing employee — the person described in 1320a–5(b); person with an ownership or control interest — the person in 1320a–3(a)(3) or one of the five largest owners.
