Title 42 › CHAPTER 7 — SOCIAL SECURITY › SUBCHAPTER XI — GENERAL PROVISIONS, PEER REVIEW, AND ADMINISTRATIVE SIMPLIFICATION › Part A — General Provisions › § 1320a–3a
Providers who want to get paid under Medicare Part B must give the Secretary clear, complete information about who owns or controls them and some key employees. They must name anyone with a 5 percent or larger direct or indirect ownership or control interest in the provider or in any subcontractor the provider owns at 5 percent or more. For each person listed, and for any managing employee, the provider must say what other Medicare-covered entities those people owned or controlled at any time during the 3-year period before the report, and whether those people have had penalties, assessments, or exclusions under sections 1320a–7, 1320a–7a, or 1320a–7b. The provider must also give employer identification numbers and Social Security numbers for the provider and the listed people. If anything changes, the provider must tell the Secretary within 180 days. The Secretary will send Social Security numbers to the Social Security Administration and EINs to the Treasury to check and correct them, and will pay those agencies for the work. Definitions: disclosing part B provider — an entity paid for Part B services on an assignment basis (with certain exceptions in section 1320a–3(a)(2)); managing employee — the person type listed in section 1320a–5(b); person with ownership or control — persons in section 1320a–3(a)(3) or the five largest owners.
