Title 42 › CHAPTER 7 — SOCIAL SECURITY › SUBCHAPTER XI — GENERAL PROVISIONS, PEER REVIEW, AND ADMINISTRATIVE SIMPLIFICATION › Part C — Administrative Simplification › § 1320d–3
The Secretary must put the standards from section 1320d–2 into effect within 18 months after August 21, 1996. Standards about claims attachments must be put in place within 30 months after August 21, 1996. After that, the Secretary must review the standards and can add or change them, but no more often than once every 12 months. Changes must be made so they cause as little disruption and cost as possible. During the first 12 months after a standard is first adopted, the Secretary may not change it unless the change is needed to allow people to comply. For code sets (the lists of codes used for health data), the Secretary must have routine maintenance and testing procedures. If a code set is changed, it must include instructions to convert old coded data so the information is kept, and the change must also minimize disruption and cost.
