Create procedures so the maximum fair price for a chosen drug is used, and used before any other health plan help or discounts. Make the price work across different strengths and forms of the drug, not by package size or exact formulation. Put steps in place to apply the rules to people in Medicare Part D, MA–PD, Part B, and MA plans. Set up the negotiation and renegotiation process required by law. Give manufacturers a way to send required information. Share needed data with the Treasury to figure the tax under Internal Revenue Code section 5000D, including the dates when agreements under sections 1395w–114a, 1395w–114c, and 1396r–8(b) end and when new ones begin. Also set procedures to apply subsections (d)(2)(B) and (f)(1)(C) of section 1320f–1. The Secretary must watch that manufacturers follow their agreements under section 1320f–2 and must create a way for people to report violations.
