Summary

The Secretary must pay a chosen proposer back for discounts the proposer gave to people who bought or leased electric vehicles, if the proposer certifies that the vehicles were bought or leased under the program and that the discounts were actually given. Once the Secretary accepts the certification, payment must be made within 30 days, but only if money was provided in advance by Congress. The refund cannot be larger than either the price difference between the electric vehicle and a comparable conventional vehicle or the price of that comparable conventional vehicle. After applying the discount and any other contributions, the buyer’s price cannot be below the manufacturer’s suggested retail price of the comparable conventional vehicle. The refund is limited to $10,000 per electric vehicle.
