Title 42 › CHAPTER 134 — ENERGY POLICY › SUBCHAPTER V — RENEWABLE ENERGY › § 13316
Creates a renewable energy technology transfer program run by the Secretary of Energy through USAID, working with an interagency group. The Secretary and the USAID Administrator must sign a written agreement within 150 days after October 24, 1992 to set up the program and to resolve project disputes. If USAID does not cover a country, the Secretary may work with other federal agencies. If the Secretary and the other agency cannot agree, each will send a memo to the President, who must pick one version within 90 days. The program must list potential projects within 240 days after October 24, 1992 and then solicit proposals within one year after that date. It must choose project proposals within 120 days after proposal deadlines. The program has nine goals, including reducing the U.S. trade deficit, keeping and creating U.S. manufacturing jobs, exporting U.S. renewable energy technologies and services, getting U.S. firms into foreign projects, and helping developing countries use renewable energy in an environmentally sound way. The Secretary, through USAID, must set up financial tools to boost U.S. firm participation, can mix U.S. and non‑U.S. funds, and must follow OECD export‑credit rules. Solicitations must require a U.S. firm to hold equity, use U.S. renewable energy technology, and may allow joint ventures. Projects must meet host‑country eligibility and development standards and be reviewed for technical, financial, and environmental merit. At least 50 percent of equipment cost must come from U.S. manufactured components (assembly abroad does not count). The Secretary and USAID must report progress to Congress every year. The law defines “host country” and says “developing country” includes Central and Eastern Europe and former Soviet states. It authorizes $100,000,000 each year for fiscal years 1993 through 1998.
