If an owner of a covered Section 8 housing project, following the Secretary’s rules, finds there are not enough disabled or near-elderly families who got a preference under section 13613 to fill the units that the preference covers, the owner must open those units to any families who applied and are eligible to live there, and ignore the special preference.
