Title 42 › CHAPTER 7 — SOCIAL SECURITY › SUBCHAPTER XVIII — HEALTH INSURANCE FOR AGED AND DISABLED › § 1395b–7
The Secretary must send each person who had a Medicare payment a statement that shows what services or items were paid for and how much was paid. The statement must also tell the person they can ask for a more detailed, item-by-item bill. A person can ask any doctor, provider, supplier, or other person in writing for an itemized bill for services paid by Medicare. The provider must give that itemized bill within 30 days. If someone knowingly refuses, they can be fined up to $100 for each failure. After getting the itemized bill, a person has 90 days to ask the Secretary to review it. The request must point out specific services not given or other billing problems, like duplicate charges. The Secretary will decide if wrong payments were made and try to recover any money paid in error. Starting in 2016, people may choose to get these statements electronically instead of by mail; the Secretary can limit how many times they can switch back but must allow at least one revocation. Beginning January 1, 2017, the Secretary must clearly inform people about the electronic option in a cost-effective way.
