Title 42 › CHAPTER 7 — SOCIAL SECURITY › SUBCHAPTER XVIII — HEALTH INSURANCE FOR AGED AND DISABLED › Part A — Hospital Insurance Benefits for Aged and Disabled › § 1395i–2a
People under age 65 who used to get disability benefits under section 426(b), who still have the same disabling condition (or are blind under section 416(i)(1)), and whose benefits stopped only because their earnings went above the amount in section 423(d)(4), and who do not already get benefits under this part, can sign up for hospital insurance under this rule. You must sign up in the way the rules say. Your first chance to enroll starts the month you are told your 426(b) benefits will end because of earnings and lasts 7 months. There is also a yearly general enrollment from January 1 through March 31 (starting in 1990). When coverage actually starts depends on when you enroll compared to the month you first become eligible: it can begin the first day of that month, the first day of the next month, the first day of the second month after you enroll, or the first day of the third month after you enroll. If you enroll during the January–March period, coverage begins on the following July 1. Coverage ends if the Secretary says you no longer meet the disability/blindness rule (effective the month after the notice), if you tell them you want to stop (month after), if you become eligible under section 426(a) or 426–1 (coverage ends the month before), or for nonpayment of premiums under rules that may allow a 90-day grace period (extendable to 180 days for good cause). Some other enrollment rules in sections 1395p(h), (i), and (m) also apply here. You must pay premiums to the Secretary as the rules require. Payments go into the Federal Hospital Insurance Trust Fund. You pay from the first month of your coverage until you die or your coverage ends, except you do not pay for any month you are eligible under section 426(b). The premium rules in sections 1395i–2(d)–(f) apply the same way to people enrolled here.
