People can enroll in the medical insurance program if they already get hospital insurance under Part A, or if they are 65 or older, live in the United States, and are either U.S. citizens or lawful permanent residents who have lived in the U.S. continuously for the 5 years right before the month they apply. If a person’s Part A ends because of the rule named in the law, they can still enroll or be treated as enrolled only to get immunosuppressive drug coverage, whether Part A ended before, on, or after January 1, 2023. They cannot use this special enrollment during any time they have other coverage that pays for those drugs — for example a job or private plan, TRICARE for Life, Medicaid or CHIP that covers the drugs, or VA coverage that covers the drugs. The Secretary, working with the Social Security Commissioner, must make a process to check eligibility. The person must sign a statement that they don’t have other coverage and must tell the Commissioner within 60 days if they enroll in other coverage.
