Title 42 › CHAPTER 7 — SOCIAL SECURITY › SUBCHAPTER XVIII — HEALTH INSURANCE FOR AGED AND DISABLED › Part D — Voluntary Prescription Drug Benefit Program › subpart 2 — prescription drug plans; pdp sponsors; financing › § 1395w–114c
Creates a program that requires drug makers to give discounted prices for certain Medicare Part D drugs dispensed to eligible enrollees on or after January 1, 2025. Manufacturers must sign agreements with the Secretary to take part: for 2025 the agreement must be signed by March 1, 2024, and for 2026 and later years by a calendar-quarter or semiannual deadline set by the Secretary. Agreements last at least 12 months and renew yearly unless ended. Pharmacies or mail-order services must be paid the difference between the negotiated price and the discounted price within 14 days for electronic claims and 30 days for other claims. Discounts must be applied before any other drug coverage or financial help. The Secretary runs the program, checks compliance, collects needed data, and sets procedures, but may not receive or pass along manufacturer funds. If a manufacturer fails to give required discounts, it must pay the missed discount amount plus an extra 25 percent and is subject to penalty rules in section 1320a–7a. Manufacturers or the Secretary may end agreements under the timing and notice rules in the law. Key terms in one line each: applicable beneficiary = a person enrolled in a prescription drug plan or MA–PD plan (not a qualified retiree plan) who has met the plan deductible and has incurred Part D costs above the annual deductible; applicable drug = a covered Part D drug that is an approved new drug or licensed biologic that is on the plan’s formulary (or otherwise covered or provided via exception), excluding certain “selected” drugs during a price period; discounted price = normally 90% of the negotiated price before an individual hits the annual out‑of‑pocket threshold and 80% once they reach that threshold, with special phase‑in percentages for certain manufacturers and subsidy‑eligible (LIS) beneficiaries (for specified manufacturers and specified small manufacturers: for those under the out‑of‑pocket threshold—2025: 99%, 2026: 98%, 2027: 95%, 2028: 92%, 2029 and after: 90%; for those at/above the threshold—2025: 99%, 2026: 98%, 2027: 95%, 2028: 92%, 2029: 90%, 2030: 85%, 2031 and after: 80%); manufacturer = an entity that makes prescription drugs (not a wholesale distributor or retail pharmacy); negotiated price = the agreed price for the drug including dispensing and any vaccine administration fees; applicable number of calendar days = 14 days for electronic claims, 30 days for other claims; qualified retiree prescription drug plan = defined elsewhere.
