The Secretary must make sure people eligible for Medicare Part D can pick from at least two different qualifying drug plans where they live. At least one choice must be a stand-alone prescription drug plan. If only one company offers all the qualifying plans in an area, that does not count as two choices. If two plans are not available, the person must be given the chance to join a backup prescription drug plan. A “qualifying plan” means either a stand-alone prescription drug plan or a Medicare Advantage plan with drug coverage (basic drug coverage or certain supplemental drug coverage when a rebate prevents any extra monthly supplemental premium). To help create choices, the Secretary may approve limited-risk plans under section 1395w–111(f). If that still does not provide choices, the Secretary must arrange a backup drug plan under section 1395w–111(g).
