The Secretary of Health and Human Services must find state rules that refuse to pay for health problems people get while receiving medical care and use those ideas to write Medicaid rules. Those Medicaid rules must take effect on July 1, 2011, and stop federal payments under section 1903 for costs tied to the listed health care‑acquired conditions. The rules must also make sure people on Medicaid do not lose access to needed care. A "health care‑acquired condition" is one shown by a secondary diagnosis code listed at 42 U.S.C. 1395ww(d)(4)(D)(iv). The Secretary must apply the hospital nonpayment rules at section 1886(d)(4)(D) to Medicaid plans and waivers, but may leave out conditions that don’t apply to Medicaid patients.
