Require state Medicaid plans to make people who can sign legal papers give the state any rights to get payment from other parties for medical care for themselves or for people they can legally represent. Those people must help the state prove paternity for children born out of wedlock, try to get support or payments from third parties, and help identify anyone who might owe for care. A person does not have to do these things if they are described in 42 U.S.C. 1396a(l)(1)(A) or if the state finds they have “good cause” not to cooperate under rules set by the Secretary that consider the best interests of those involved. States must work with other state agencies, courts, and law enforcement to enforce and collect these payments. When the state collects money under these assignments, it keeps what it needs to repay the Medicaid costs (and repays the federal share as required) and gives the rest to the person.
