Title 42 › CHAPTER 7 — SOCIAL SECURITY › SUBCHAPTER XIX — GRANTS TO STATES FOR MEDICAL ASSISTANCE PROGRAMS › § 1396w–3
States that want federal Medicaid money for calendar quarters after January 1, 2014 must follow the rules below. Each State must build an online system that lets people apply for, enroll in, renew, and sign up electronically for Medicaid or a Medicaid waiver. The State must automatically enroll people the State’s health insurance Exchange identifies as eligible for Medicaid or for the State Children’s Health Insurance Program (CHIP). If someone is found not eligible for Medicaid or CHIP, the State must check them for eligibility for Exchange plans and for premium help (tax credits under section 36B and advance payments under section 18082) and enroll them in those plans without a new application when possible. The State Medicaid agency, the State CHIP agency, and the Exchange must use a secure electronic connection to share eligibility and enrollment information. The State must also coordinate care for people who have both Medicaid/CHIP and an Exchange plan, do outreach to underserved groups, and may make agreements with the Exchange to decide premium help if Treasury rules are met. States must join the streamlined enrollment system under section 18083. The State must have a public website working by January 1, 2014 that is linked to the Exchange and CHIP. The site must let people compare benefits, premiums, and cost-sharing under Medicaid or a waiver with those of Exchange plans, including comparisons for children and family coverage. States still must perform needed assessments for home and community-based services.
