Title 42 › CHAPTER 7 — SOCIAL SECURITY › SUBCHAPTER XX — BLOCK GRANTS AND PROGRAMS FOR SOCIAL SERVICES AND ELDER JUSTICE › Part I — National Coordination of Elder Justice Activities and Research › subpart a — elder justice coordinating council and advisory board on elder abuse, neglect, and exploitation › § 1397k–1
Creates an Advisory Board on Elder Abuse, Neglect, and Exploitation to make short- and long-term plans for elder justice and to give advice to the Elder Justice Coordinating Council. The board will have 27 members chosen by the Secretary from people in the public with experience in preventing, finding, treating, intervening in, or prosecuting elder abuse. The Secretary must ask for nominations in the Federal Register. Members serve 3-year terms, but at first nine serve 3 years, nine serve 2 years, and nine serve 1 year. Vacancies are filled the same way and appointees serve the rest of the term. The board elects a Chair and Vice Chair at its first meeting. The board must work to improve long-term care quality and prevent abuse, and form multi‑discipline panels to reach agreement on key issues (including resident-to-resident abuse). Panels review research, identify best practices, find practical ways to use them, and plan how to share the information. The board must send a report 18 months after March 23, 2010, and every year after that, to the Elder Justice Coordinating Council, the Senate Committee on Finance, and the House Committees on Ways and Means and on Energy and Commerce. Reports must cover the status of elder justice work, recommendations on programs, laws, data collection, coordination with related areas, and a strategic plan. Members are unpaid but may get travel pay for up to 4 meetings a year. The board can get information from federal agencies (as allowed by related rules), request data from elder-justice entities, use the mail, and federal employees may be detailed to help. Funds are authorized as needed.
