Title 42 › CHAPTER 8 — LOW-INCOME HOUSING › SUBCHAPTER II–A — HOPE FOR PUBLIC HOUSING HOMEOWNERSHIP › § 1437aaa–3
Requires public housing agencies to set up homeownership programs that let eligible families buy ownership interests or shares in at least half of the units. Ownership can be by cooperative share, condo, or similar forms. Sales must be priced so a buying family pays no more than 30 percent of their adjusted monthly income for the sale costs (including loan payments, insurance, taxes, interest, and closing costs). Each program must include a plan for choosing participants, helping people who move, keeping units affordable, giving ongoing buyer and owner training, and replacing any units lost. The program must usually sell or fix up whole projects (not single buildings) unless the Secretary allows otherwise. Applications must show how rehabilitation and purchases will be financed. Transferred property generally cannot be used as loan collateral unless the Secretary finds it won’t hurt low-income access and loan payments can be covered, and lenders must give a chance to fix defaults before foreclosure. Units must be safe before transfer and meet set standards within 2 years. Tenants who do not buy cannot be evicted for the program, may stay at affordable rents or be offered other housing or vouchers, get relocation help if they move, and keep their public housing rights.
