Title 42 › CHAPTER 8A — SLUM CLEARANCE, URBAN RENEWAL, AND FARM HOUSING › SUBCHAPTER III — FARM HOUSING › § 1490p
Requires the Secretary to tell the public when housing help is available and how to apply. The Secretary must publish in the Federal Register the availability, the application form and steps, and the rules used to pick winners at least 30 days before any application deadline. Awards must be based on a written, approved application unless the law says otherwise. The Secretary must keep records that explain why help was granted or denied and make each application and related documents available for public inspection for at least 10 years, starting no less than 30 days after an award. In an emergency, the Secretary can skip the notice, application, or timing rules, but must publish the reasons in the Federal Register at least 30 days after the waiver. Applicants who have received, or are expected to receive, assistance in excess of $200,000 in the aggregate in any fiscal year must disclose other government help for the project, the names and money interests of people with a financial stake (like developers, contractors, or consultants), and the expected sources and uses of funds. They must update those disclosures within 30 days of any major change while the application is pending or help is being provided. If the Secretary finds a likely violation, the Secretary may stop the selection, cancel awards, hold hearings, impose sanctions (including debarment), recover funds, or take other actions and must publish what was done. Civil fines can be up to $100,000 for an individual or $1,000,000 for others, and fines go to the Rural Housing Insurance Fund. The Secretary must certify that any help is no more than needed for affordable housing after counting other government aid and must adjust help for reported changes. The Secretary must issue rules at least 180 days after December 15, 1989, and must report to Congress within 180 days after December 15, 1989 about steps taken and staff training. Assistance: any housing grant, loan, guarantee, insurance, rebate, subsidy, tax credit, or other direct or indirect help for original construction or development.
