Title 42 › CHAPTER 8A — SLUM CLEARANCE, URBAN RENEWAL, AND FARM HOUSING › SUBCHAPTER III — FARM HOUSING › § 1490u
The Secretary must run a program to save and fix up multifamily rental housing that was financed under sections 1484, 1485, or 1486. Each year the Secretary must send owners a written notice if their loan will come due within the next 4 years. Tenants must get a written notice at least 2 years before a loan matures that tells them the maturity date, what might happen to the building, and how to protect their right to stay or get a housing voucher. Tenant notices must be in plain English and translated where many residents speak other languages. The Secretary can change loans to keep buildings safe and affordable. Changes can include lowering or stopping interest, delaying payments, changing debt terms, giving financial help, or removing some units from income limits when vacancies exist. If a loan is restructured, the Secretary must offer to renew rental assistance for the shorter of 20 years or the new loan term, if Congress provides money and the owner keeps the building decent and affordable. If restructuring isn’t feasible, the Secretary may still renew rental assistance for 20 years for certain borrowers. Rents are generally set by current fair market rents and can be adjusted yearly, but the Secretary can approve higher, budget-based rents if needed. Owners must give a plan for repairs and financing before approval. The Secretary may give grants to nonprofits, co-ops, and public housing agencies to help preserve at-risk buildings. Up to $1,000,000 of program funds may be used each year for administration. Not later than 180 days after July 11, 2026, the Secretary must publish an advance notice of proposed rulemaking and consult stakeholders, and not later than 1 year after July 11, 2026, must publish an interim final rule to carry out the program.
