Secretary of State must give a written certificate to a U.S. citizen adoptive parent (or to a prospective citizen parent who has legal custody) for each Hague Convention adoption. The Secretary will do this only after getting notice from the child’s country central authority and confirming the Convention and U.S. rules were followed. If the certificate is attached to the original foreign adoption decree, it counts as final proof for federal and state agencies and as the certification required by section 1154(d)(2) of title 8. A foreign Convention adoption that the Secretary certifies is treated as a valid final adoption under all U.S. laws. U.S. courts may not enter a final adoption order for a child who came from another Convention country for adoption unless that certificate has been issued.
