The Secretary, together with the Attorney General, must issue rules within 180 days after October 6, 2000 that set how Convention records are kept. The Secretary must follow subsections (b), (c), and (d) of section 553 of title 5 when making those rules. Only the Secretary or the Attorney General may release Convention records, and then only if the records are kept under the Immigration and Nationality Act and federal law allows it. They may share records with the Secretary, the Attorney General, central authorities, accredited agencies, and approved persons when needed to run the Convention or this chapter. Illegal release is punishable under federal law. Adoption records that are not Convention records are controlled by State law.
