Title 42 › Chapter 143— INTERCOUNTRY ADOPTIONS › Subchapter IV— ADMINISTRATION AND ENFORCEMENT › § 14944
Makes it a crime to break a related rule in the law, to lie or mislead about important facts, or to offer, give, or take payments or other favors to influence decisions in the U.S. or another country about accreditation, giving up parental rights or parental consent in Convention adoptions, or actions by a central authority. It is also illegal to hire an agent who does any of those things. The Attorney General can sue in federal court to enforce these rules. Courts must consider how serious the violation was, how blameworthy the person is, and any past violations when deciding penalties. If someone does these acts on purpose and knowing they are wrong, they can be fined up to $250,000, jailed up to 5 years, or both.
