The Secretary must make incentive payments to owners or operators of "qualified hydroelectric facilities" to help pay for capital improvements. A "qualified hydroelectric facility" is a hydroelectric project that either has a Federal Energy Regulatory Commission license or was built under a permit or right-of-way granted before June 10, 1920 (or under a Federal Power Act license), was put into service before November 15, 2021, and already meets federal, tribal, and state rules or would meet them because of the funded work. Payments can fund work that improves grid resiliency (for example, faster grid response, black start, voltage support, integrating variable resources, or handling reservoir sediment), dam safety (for example, spillway or stability fixes and floodgate upgrades), or environmental and recreation improvements (for example, fish passage, water quality, sediment and habitat, and access for boating and trails). Payments may cover no more than 30% of a project’s cost. Only one payment per facility is allowed in a fiscal year, and that payment cannot exceed $5,000,000. Congress authorized $553,600,000 for fiscal year 2022, to remain available until spent.
