Title 42 › Chapter 9— HOUSING OF PERSONS ENGAGED IN NATIONAL DEFENSE › Subchapter IX— DEFENSE HOUSING AND COMMUNITY FACILITIES AND SERVICES › § 1592i
Workers on construction, maintenance, repair, or demolition projects paid under this program must be paid for an eight-hour workday. Any time over eight hours in a day must be paid at least one and one‑half times the basic rate. The federal wage and labor rules in sections 3141–3144, 3145, 3146, and 3147 of Title 40 and section 874 of Title 18 apply. Contracts for loans or grants must promise to pay at least the local prevailing wages set by the Secretary of Labor, and the Secretary of Housing and Urban Development must get a certification that this is followed before making any payment. Contractors and their subcontractors must report each month to the Secretary of Labor, within five days after the month ends, on forms from the Department of Labor. Reports must show how many people worked on the project, total payroll, total hours worked, and itemized material costs. Contractors must also give the Department the names and addresses of subcontractors as soon as possible. The Secretary of Labor will set rules and run investigations to enforce these labor rules, and HUD must follow those rules.
