Title 42 › Chapter 9— HOUSING OF PERSONS ENGAGED IN NATIONAL DEFENSE › Subchapter XI— HOUSING FOR MILITARY PERSONNEL › § 1594
Allows the Secretary of Defense (or someone he picks) to hire contractors to build urgently needed housing on U.S. land near military bases for service members. Each finished housing unit becomes controlled by the Secretary of Defense as soon as the Secretary of Housing and Urban Development (HUD) says it is ready. If the builder is a corporation that holds the mortgage, its capital stock (except HUD’s stock) must be turned over to the Secretary when HUD says the work is done. Contracts must protect the United States, and must require performance and payment bonds with surety acceptable to the Secretary. Those bonds satisfy section 3131 of title 40 so no extra bonds are needed. The Secretary must invite competitive bids and advertise as required by chapters 221 and 241 of title 10. Eligible bidder — a person, partnership, firm, or corporation the Secretary of Defense, after talking with HUD, finds experienced, financially responsible, and the lowest acceptable bidder. The Secretary may buy the stock of companies that hold mortgages insured under title VIII of the National Housing Act (as amended by the Housing Amendments of 1955), act as owner while the mortgage exists, dissolve the company after the mortgage ends, and guarantee or pay notes or losses when needed, including protecting the Armed Services Housing Mortgage Insurance Fund. The Attorney General must give a legal opinion on title if asked. If title is good, the Secretary may guarantee the mortgagee against title claims on mortgages insured under title VIII. Mortgage proceeds may not be used for title searches or title insurance unless the Secretary finds in writing that title insurance is needed for financing; then he may pay reasonable title costs from the revolving fund under section 1594a(g) and must promptly tell the Armed Services Committees and report the amount paid.
