If a defendant agrees in a settlement to do a diesel emissions reduction Supplemental Environmental Project, the EPA Administrator must make the defendant sign a statement under penalty of law saying they would have done a similarly valued different project if the law prevented EPA from accepting a diesel SEP. If the Administrator does not include that statement, the omission does not let anyone sue the United States under the Clean Air Act or any other law, and it cannot be used to undo the settlement.
