The Secretary must create a rule about how much carbon is allowed when making clean hydrogen. That rule had to be finished within 180 days after November 15, 2021. The Secretary must work with the EPA Administrator and get input from industry and other stakeholders. The rule must cover hydrogen made from renewables, fossil fuels with carbon capture, nuclear, and other fuel types, and must consider what is technically and economically feasible. The law says "clean hydrogen" means hydrogen made with a carbon intensity of 2.0 kilograms of CO2‑equivalent or less for each kilogram of hydrogen at the production site. Within five years after the rule is made, the Secretary must review whether to lower that 2.0 kg limit and must lower it if appropriate.
