Title 42 › Chapter 11— COMPENSATION FOR DISABILITY OR DEATH TO PERSONS EMPLOYED AT MILITARY, AIR, AND NAVAL BASES OUTSIDE UNITED STATES › § 1655
The Secretary of Defense must create a plan for buying the insurance required by the Defense Base Act that lowers costs for the Department and for contractors. The plan must cut overhead and administration costs, keep coverage costs down using realistic estimates of claims, tie premiums to actual claims using best practices, keep the Department’s risk low, and keep the insurance market competitive when possible. The Secretary may consider different ways to do this, including one single Defense Base Act insurance contract. No later than 270 days after October 14, 2008, the Secretary must send a report to the Senate and House Armed Services Committees, the Senate Committee on Homeland Security and Governmental Affairs, and the House Committee on Oversight and Government Reform. The report must describe the options considered, show how each meets the criteria above, and include a plan to put the chosen plan into action within 18 months after October 14, 2008. The Secretary must review and update the plan as needed, but at least once every 3 years.
