The United States will repay an employer, its insurer, or its compensation fund when they pay benefits because an injury, detention, or death was caused by a war-related hazard. Repayment covers three kinds of payments: benefits under workers’ compensation laws; benefits paid because of a contract-related agreement in effect on December 2, 1942 that covered deaths or failure to provide return transportation after employment; and benefits paid under U.S.-approved agreements where a contractor agreed to pay for detention by a hostile force or for war-risk injury or death. No repayment is allowed if the Secretary finds the benefits were for a war risk for which a premium (including any extra charge) was charged. These rules do not apply to injuries or deaths that happened within any State.
