Title 42 › CHAPTER 152 — ENERGY INDEPENDENCE AND SECURITY › SUBCHAPTER II — ENERGY SECURITY THROUGH INCREASED PRODUCTION OF BIOFUELS › Part C — Biofuels Infrastructure › § 17052
Creates a grant program to help fuel stations and other businesses install, replace, or convert tanks and pumps so they can sell renewable fuel blends. A “renewable fuel blend” means gasoline with 11%–85% renewable fuel or diesel with at least 10% renewable fuel. The Secretary must set rules within 12 months after December 19, 2007 for picking who gets grants to make these fuels available widely. The rules must look at local demand (including state counts of flexible-fuel vehicles), chances to build highway corridors, applicant experience, population and vehicle numbers, and give priority to projects that most cut petroleum use, use existing equipment when possible, and show strong local funding and plans to keep the project going. Grants can pay no more than 33% of a project’s cost and no more than $180,000 for equipment at one retail location. Grant recipients must sell the fuel to the public, run a marketing plan that tells consumers price and availability, label dispensers, report sales, fuel types and prices, and tell the Secretary when a station opens so it can be listed on the station locator. People who get the tax credit under section 30C of title 26 cannot get these grants. The Secretary must also fund technical and marketing help for grantees. A separate pilot program will award up to 10 geographically spread grants to states, tribes, local governments, or their partnerships to build refueling corridors. The pilot has application deadlines, a $20,000,000 cap per applicant, at least 20% non-Federal cost share, a 2-year maximum grant period, and requirements to share results. Congress must get reports after grants are awarded and regular evaluations. Up to $200,000,000 is authorized each year for fiscal years 2008 through 2014.
