Title 42 › Chapter 13— SCHOOL LUNCH PROGRAMS › § 1766a
The Secretary must run a program that helps States pay for extra meals for children in afterschool care at eligible elementary and secondary schools. Eligible schools are those that run school lunch programs under this chapter, run afterschool care, and have afterschool activities with an educational or enrichment purpose. Reimbursement can only be for children not more than 18 years of age, except as provided in section 1760(d)(1)(A) of this title. If a program site is in an area served by a school where at least 50 percent of enrolled children are certified for free or reduced price meals, the snacks or meals must be served free and reimbursed at the free rate under section 1766(c)(3) of this title. For other sites, the national average payment rate equals the rates in section 1766(c)(3) (as adjusted under section 1759a(a)(3) of this title). Meal content must follow the same rules that apply to child care food programs under this chapter.
