The Secretary must write rules needed to carry out this chapter and the Richard B. Russell National School Lunch Act. The rules must cover how food is served in schools and in places that compete with the school programs. The Secretary must set science-based nutrition rules for foods sold in schools that are not part of school meals and must publish proposed rules not later than 1 year after December 13, 2010. The rules apply to all foods sold on campus, outside school meal programs, and during the school day. The standards must follow the most recent Dietary Guidelines for Americans (published under section 5341 of title 7) and must take into account scientific advice, existing state and local standards, practical issues, and limited exemptions for occasional school fundraisers (but not fundraisers using vending machines, school stores, snack bars, a la carte sales, or other exclusions the Secretary sets). After a new Dietary Guidelines edition is published, the Secretary must review and update the school standards as soon as practicable. Interim or final rules take effect at the start of a school year that is not earlier than 1 year and not later than 2 years after the rules are finalized. The Secretary must send quarterly reports to the Senate Committee on Agriculture, Nutrition, and Forestry and the House Committee on Education and Labor about progress. The Secretary may allow States to transfer funds between the programs under this chapter and the National School Lunch Act under an approved State plan, and may reserve up to 1 percent of funds available for apportionment to any State for special development projects.
