Title 42 › Chapter 13A— CHILD NUTRITION › § 1785
States, state education agencies, schools, and nonprofit groups in these programs must keep the records the Secretary needs to check that rules were followed. The Secretary’s staff can inspect or audit those records at reasonable times, and the records must be kept as long as the Secretary requires but not more than three years. The Secretary may set the amount of, settle, change, deny, or waive claims under this chapter or the Richard B. Russell National School Lunch Act. That does not limit the Attorney General’s power under section 516 of title 28 to represent the United States in court.
