Organizations that routinely send or receive protected health information for a covered entity must sign written agreements that follow 45 C.F.R. 164.502(e)(2) and 164.308(b). Examples are HIEs, RHIOs, e‑prescribing gateways, and vendors that let a covered entity offer personal health records. Those organizations will be treated as business associates for the rules in this subchapter and in subparts C and E of part 164 of title 45, as those rules were on February 17, 2009.
