Title 42 › CHAPTER 156 — HEALTH INFORMATION TECHNOLOGY › SUBCHAPTER III — PRIVACY › Part B — Relationship to Other Laws; Regulatory References; Effective Date; Reports › § 17953
Require the Secretary to send yearly reports to Congress, starting the first year after February 17, 2009, about complaints the Department gets on health privacy and security rules. Each report must say how many complaints were filed, how many were handled informally and what help was given, how many led to fines or settlements and the amounts, how many compliance reviews and audits were done and their results, how many subpoenas or inquiries were issued, and the Secretary’s plan to improve enforcement. Those reports must be posted on the Department of Health and Human Services website. Within one year after February 17, 2009, the Secretary, with the Federal Trade Commission, must study privacy and security rules for groups not covered by HIPAA (for example, vendors of personal health records, their website partners, and their service providers), decide which federal agency should enforce any new rules, set a timetable for regulations, and send findings and recommendations to the named Senate and House committees. Also within 12 months the Secretary must issue guidance on how to de-identify protected health information under 45 C.F.R. 164.514(b). The Comptroller General must, within one year, report to the named committees on best practices for sharing patient information for treatment. Finally, within 5 years the Government Accountability Office must report to Congress and the Secretary on how the Act affected insurance premiums, health care costs, electronic health record use, and medical errors, and the Secretary must study whether to change the definition of “psychotherapy notes” to include certain test data and may issue regulations.
