Title 42 › CHAPTER 162 — ENERGY INFRASTRUCTURE › SUBCHAPTER V — ENERGY EFFICIENCY AND BUILDING INFRASTRUCTURE › Part A — Residential and Commercial Energy Efficiency › § 18792
Creates a program requiring the Energy Department to give states money to start revolving loan funds for energy-efficiency work. The Department must set up the program within one year after November 15, 2021. A total of 40 percent of the money must be split among all eligible states using the allocation formula in 10 C.F.R. 420.11 (or its replacement). Sixty percent goes to “priority” states using a formula the Department makes. Any unclaimed money is reallocated to other states. A priority-state supplemental grant cannot be more than $15,000,000 and must add to, not replace, the regular grant. States must apply with a plan showing how they will set up the fund, who needs help, and the expected community benefits. States must deposit grant money into a revolving loan fund and begin using it within 180 days of getting the grant. Funds can be used for loans (and some grants) for commercial and residential energy audits, and for upgrades or retrofits based on those audits. Audits must measure energy use, recommend life‑cycle cost‑effective fixes (examples: lighting, HVAC, windows, appliances, insulation), estimate savings with approved software, and give a Home Energy Score for homes. Upgrade loans must be paid off by the earlier of the upgrades’ useful life or 15 years. States may use up to 25 percent of funds for grants or technical help to small businesses and low‑income homeowners, and up to 10 percent for admin. States should build on existing programs and try to leverage private money. The Department must tell states about the grants. Each grantee must report within 2 years on how many loans and grants it made and the average cost of upgrades. Congress authorized $250,000,000 for fiscal year 2022, available until spent.
